States’ laws provide benefits to employees who are hurt while traveling temporarily outside of the country. This endorsement provides some clarity as to time considerations and coverage that is afforded. It is used frequently with pilots and crew.
This endorsement offers statutory benefits to classes of workers whose benefits do not apply according to the statutes of the state. Examples of persons who might be afforded benefits with this endorsement vary by state but can include executive officers, partners, sole proprietors, farm workers, domestic employees, athletes, or employees traveling overseas.
This endorsement is used to waive the insurance company’s rights of subrogation against named third parties that are listed on the endorsement schedule and that may be held responsible for an injury. A “blanket” version of this endorsement is also available. A Waiver of Subrogation endorsement is frequently used by businesses that operate from municipal airports, as required by contract.
DBA coverage provides compensation for disability or death to persons who are injured while employed at military, naval, and air bases outside the United States. Today, almost any contract with a U.S. government agency for work outside the U.S. of a military or related nature will likely require Defense Base Act coverage.
Stop-gap coverage is essentially Part Two Employers Liability coverage provided to support operations in a monopolistic state (North Dakota, Ohio, Washington, Wyoming). In these states, workers’ compensation coverage is provided by the state but employer’s liability is not included in that coverage; therefore, employers must procure coverage in the open or private market. This coverage can also be added as part of a general liability policy rather than by endorsement to the workers’ compensation policy.
